The Delaware Court of Chancery, in Robert O. Carr v. Global Payments, Inc., et al., C.A. No. 2018-0565-SG, memo. op. (Del. Ch. Oct. 31, 2019), permitted modification of a prior advancement order to eliminate a former officer and director’s entitlement to advancement of expenses incurred defending claims defendant brought against him after defendant amended its complaint in the underlying action to remove certain claims and allegations for which advancement was granted.
